As eligibility requirements and availability of the various vaccines have expanded and as more adults receive the vaccine, the Centers for Disease Control and Prevention (CDC) and the Pennsylvania Department of Health (DOH) have been constantly monitoring rules surrounding exposure, isolation, and quarantine.<\/p>\n<h3>Current CDC Guidelines<\/h3>\n<p>In the workplace and in school settings, this has been a moving target over the past several weeks, and it may seem as though the recommendations and guidelines are changing daily. Generally, the rules for isolation and quarantine for a person identified as a close contact to someone who is positive for COVID-19 have been waived if the close contact meets three criteria points:<\/p>\n<ol>\n<li>You are fully vaccinated. You are not considered fully vaccinated until two weeks have passed following the second dose of the Pfizer or Moderna vaccine or the single dose of the Johnson &amp; Johnson vaccine.<\/li>\n<li>The exposure occurred within three months of your receiving the last shot in the series.<\/li>\n<li>You have remained asymptomatic since the exposure.<\/li>\n<\/ol>\n<p>However, if the COVID-19-positive individual resides in your household, then the new waiver rules do not apply, and you will likely have to quarantine. As always, close contacts should follow the directions of DOH in regard to isolation and quarantine.<\/p>\n<p>These points are important to keep in mind as the race between vaccination and a dreaded fourth wave of infection goes on. Last week, Governor Tom Wolf verified that Pennsylvania was in the midst of the fourth wave, but he believed that the pace of vaccinations would win out over the fourth wave. However, with even more recent news that usage of the Johnson &amp; Johnson vaccine will be temporarily paused, the Commonwealth runs a risk of falling behind in that race.<\/p>\n<h3>Workplace Mandates<\/h3>\n<p>As the Commonwealth expands into this new phase of all-adult eligibility, questions\u00a0<span data-contrast=\"auto\">have\u00a0<\/span><span data-contrast=\"auto\">beg<\/span><span data-contrast=\"auto\">un<\/span><span data-contrast=\"auto\">\u00a0to arise as to whether an employer can require an employee to be vaccinated\u00a0<\/span><span data-contrast=\"auto\">in order to<\/span><span data-contrast=\"auto\">\u00a0return to a physical workplace. Initially, guidance from employment commissions suggested that such vaccination requirements would not be permissible.<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">However, as founding partner Dan Lynch recently <\/span><span data-contrast=\"auto\">discuss<\/span><span data-contrast=\"auto\">ed in\u00a0<\/span><span data-contrast=\"auto\">his\u00a0<\/span><span data-contrast=\"auto\">article \u201c<\/span><a href=\"https:\/\/archive-lynchlaw.pfgsandbox.com\/will-i-have-to-vaccinate\/\" target=\"_blank\" rel=\"noopener\"><span data-contrast=\"auto\">W<\/span><span data-contrast=\"auto\">ith\u00a0<\/span><span data-contrast=\"auto\">E<\/span><span data-contrast=\"auto\">mergency\u00a0<\/span><span data-contrast=\"auto\">A<\/span><span data-contrast=\"auto\">pproval of a\u00a0<\/span><span data-contrast=\"auto\">V<\/span><span data-contrast=\"auto\">accine,\u00a0<\/span><span data-contrast=\"auto\">W<\/span><span data-contrast=\"auto\">ill\u00a0<\/span><span data-contrast=\"auto\">I<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">H<\/span><span data-contrast=\"auto\">ave to\u00a0<\/span><span data-contrast=\"auto\">Vaccinate?<\/span><\/a><span data-contrast=\"auto\">\u201d<\/span><span data-contrast=\"auto\">\u00a0the EEOC and other commissions have<\/span><span data-contrast=\"auto\">\u00a0now<\/span><span data-contrast=\"auto\"> indicated that an employer may require that employees obtain vaccines before returning to the workplace.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">This raises another question: What information can my employer require that I give about my COVID and vaccination history? This is best answered using\u00a0the\u00a0age-old adage of the \u201c5\u00a0W\u2019s\u201d:\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<ul>\n<li><strong> Who:<\/strong> <span data-contrast=\"auto\">An employer\u00a0is permitted\u00a0to ask each individual employee whether\u00a0they have\u00a0received the\u00a0vaccine.<\/span><span data-ccp-props=\"{&quot;134233279&quot;:true,&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/li>\n<li><strong> What:<\/strong> <span data-contrast=\"auto\">An employer\u00a0is permitted\u00a0to ask what vaccine the employee\u00a0received.<\/span><span data-ccp-props=\"{&quot;134233279&quot;:true,&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/li>\n<li><strong> Where:<\/strong> <span data-contrast=\"auto\">An employer\u00a0may be permitted\u00a0to ask where the employee received the vaccine, but this element is\u00a0unclear,\u00a0and caution should be used in asking this question.<\/span><span data-ccp-props=\"{&quot;134233279&quot;:true,&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/li>\n<li><strong> When:<\/strong> <span data-contrast=\"auto\">An employer\u00a0is permitted\u00a0to ask when the employee received the vaccine.<\/span><span data-ccp-props=\"{&quot;134233279&quot;:true,&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/li>\n<li><strong> Why:<\/strong> <span data-contrast=\"auto\">An employer is never permitted to ask an employee why they did or not receive the vaccine, or a particular vaccine, or any other question that may inquire beyond the information needed to determine that a vaccine has been received.<\/span><span data-ccp-props=\"{&quot;134233279&quot;:true,&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/li>\n<\/ul>\n<h3>The Bottom Line<\/h3>\n<p>The key point to the permitted questions is to enable an employer to track employees&#8217;<span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">quarantin<\/span><span data-contrast=\"auto\">ing<\/span><span data-contrast=\"auto\"> following exposure to COVID-19.\u00a0<\/span><span data-contrast=\"auto\">In other words,\u00a0<\/span><span data-contrast=\"auto\">questions\u00a0<\/span><span data-contrast=\"auto\">beyond<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">those that identify\u00a0<\/span><span data-contrast=\"auto\">whether<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">an employee<\/span><span data-contrast=\"auto\">\u00a0has<\/span><span data-contrast=\"auto\">\u00a0received the vaccine,\u00a0<\/span><span data-contrast=\"auto\">the type of vaccine<\/span><span data-contrast=\"auto\">, and\u00a0<\/span><span data-contrast=\"auto\">the date the vaccine\u00a0<\/span><span data-contrast=\"auto\">was received<\/span><span data-contrast=\"auto\">\u00a0<\/span><strong>will likely\u00a0be considered\u00a0improper inquiries into an employee\u2019s medical history<\/strong><span data-contrast=\"auto\">.\u00a0<\/span><span data-contrast=\"auto\">Without authorization from the employee, these illicit questions <\/span><span data-contrast=\"auto\">c<\/span><span data-contrast=\"auto\">ould likely land an employe<\/span><span data-contrast=\"auto\">r<\/span><span data-contrast=\"auto\">\u00a0into trouble with its state\u2019s human relations commission and\/or the EEOC.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<h4>Pittsburgh Employment Attorneys<\/h4>\n<p>The rules regarding vaccinations, quarantine, and employment are constantly evolving.
