{"id":1989,"date":"2016-11-30T12:29:46","date_gmt":"2016-11-30T17:29:46","guid":{"rendered":"\/?p=1989"},"modified":"2021-07-01T10:43:17","modified_gmt":"2021-07-01T14:43:17","slug":"government-rule-on-employee-overtime-pay-on-hold","status":"publish","type":"post","link":"https:\/\/archive-lynchlaw.pfgsandbox.com\/?p=1989","title":{"rendered":"Government Rule on Employee Overtime Pay on Hold"},"content":{"rendered":"<h6><img fetchpriority=\"high\" decoding=\"async\" class=\"alignnone size-large wp-image-8929\" src=\"https:\/\/archive-lynchlaw.pfgsandbox.com\/wp-content\/uploads\/2016\/11\/JM-Industrial-800_1653-web-1024x684.jpg\" alt=\"\" width=\"1024\" height=\"684\" srcset=\"https:\/\/archive-lynchlaw.pfgsandbox.com\/wp-content\/uploads\/2016\/11\/JM-Industrial-800_1653-web-1024x684.jpg 1024w, https:\/\/archive-lynchlaw.pfgsandbox.com\/wp-content\/uploads\/2016\/11\/JM-Industrial-800_1653-web-300x200.jpg 300w, https:\/\/archive-lynchlaw.pfgsandbox.com\/wp-content\/uploads\/2016\/11\/JM-Industrial-800_1653-web-768x513.jpg 768w, https:\/\/archive-lynchlaw.pfgsandbox.com\/wp-content\/uploads\/2016\/11\/JM-Industrial-800_1653-web.jpg 1366w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><\/h6>\n<h3><span style=\"font-family: georgia, palatino, serif;\">The News<\/span><\/h3>\n<p>On November 22nd, a federal judge in Texas halted the implementation of a new government rule on employees eligible to receive overtime pay.<\/p>\n<h3>The Backstory<\/h3>\n<p>Under federal law, employers must pay certain workers overtime pay (i.e., \u201ctime-and-a-half\u201d) if they work more than 40 hours in a workweek.\u00a0 The question with which employers have always struggled has been, \u201cwhich workers must be paid overtime and which do not?\u201d\u00a0 Under current law, employees making more than a certain amount ($23,660) and whose duties are of a certain character (e.g., managerial or professional) are ineligible for overtime pay.\u00a0 Employees earning less must be paid overtime.<\/p>\n<p>In May of this year, the federal Department of Labor issued a new rule on overtime pay.\u00a0 Under the new rule, employees who do not earn at least $47,476 per year must be paid overtime, even if they are managerial or professional employees.\u00a0 The new rule would extend overtime pay to 4.2 million employees not currently entitled to it.\u00a0 The new rule also provides for an increase in this salary threshold every three years.<\/p>\n<p>The new rule was to have taken effect on December 1st.
